Terms of service
These terms sit behind the offer. They are written to be readable by a tradesperson in five minutes, because terms nobody reads protect nobody.
Who this agreement is between
Don Designs ("we", "I"), operated by Ross Digby, based in Leicestershire, with a business address at 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom, and the business named on the order ("you"). Services are provided to businesses, not consumers.
What you are buying
A website, built by us, shown to you working before you pay anything. The setup fee is £447. The monthly service fee is £187, and covers hosting, your domain from first payment onwards, SSL, keeping the site running, and up to 30 minutes of content changes each month. You can buy the site outright at any point for 12x your monthly fee. Current prices are on the pricing page.
The free-look promise
Until you say yes, the site remains a private demonstration and search engines cannot index it. It costs you nothing. If you say no, we delete the private preview. No invoice and no follow-up.
Rolling monthly, cancelling
- The monthly fee is rolling. There is no minimum term.
- Cancel any month with thirty days notice by email.
- We can also end the agreement with thirty days notice.
- If a monthly payment fails and stays unpaid for fourteen days after we let you know, we may take the site offline until it is settled.
The site and domain if you leave
- The domain name is yours. It is registered in your business's name from first payment, and if you cancel we hand over full control of it at no charge.
- The words, photos and reviews on the site are yours. We will give you a copy of all of it on request.
- The site design and code remain ours. The monthly fee licenses them to you while the agreement runs. If you cancel, the site comes down, and you are free to have anyone rebuild you a site on your domain.
Content changes
Up to 30 minutes of content changes are included each month, such as prices, photos, opening hours and wording. Bigger work is quoted before we do it, and nothing is ever billed without you agreeing the price first. We manage the site on your behalf, so if you want something changed, email us and we will do it.
What we promise, and what we do not
- We keep the site online, secure and backed up. If it goes down because of something on our side, fixing it is our job and our cost.
- We build the site so search engines can index it properly. We do not promise rankings, traffic or enquiries. Anyone who promises those is guessing.
- When you report a problem, we tell you the expected next step.
Your responsibilities
- The facts on your site, such as services, prices, accreditations and coverage area, are yours to confirm. We publish what you approve.
- You confirm you have the right to use the photos and text you give us.
- Reviews shown on the site are your real customer reviews. We do not invent or edit reviews and will not publish any you ask us to fabricate.
Data
Enquiries from your site's form go straight to you. We hold a copy only as long as needed to keep the form working, and never use your customers' details for anything else. Our privacy notice for site visitors is published on every live site we run.
Liability
We carry professional care for the work, but our total liability under this agreement is capped at the fees you have paid us in the twelve months before the issue arose. Neither of us is liable to the other for indirect losses. Nothing in these terms limits liability that cannot legally be limited.
The boring but necessary
- These terms are governed by the law of England and Wales.
- If one clause turns out to be unenforceable, the rest still stand.
- Changes to these terms reach you in writing thirty days before they apply, and if you do not like a change you can cancel before it lands.
